What Georgia law says about your claim
Four parts of Georgia law shape almost every injury claim. Knowing them early helps you avoid mistakes that are hard to undo.
The deadline to file
Most Georgia injury and wrongful-death lawsuits must be filed within two years (O.C.G.A. § 9-3-33). Property damage claims get four years (O.C.G.A. § 9-3-31).
Claims against a government move much faster. Written notice to a city is due within 6 months (O.C.G.A. § 36-33-5). Notice to a county or the State is due within 12 months (O.C.G.A. § 36-11-1 and § 50-21-26).
If a MARTA bus, a city truck or a road defect played a part, special notice rules can apply, so call right away.
Fault
Georgia follows modified comparative negligence (O.C.G.A. § 51-12-33). If you are 50% or more at fault, you recover nothing.
Under 50%, your award is reduced by your share. Someone found 20% at fault receives 80% of their damages. Expect the insurer to argue that you share the blame.
Insurance
Georgia is an at-fault state. The driver who caused the crash, through their liability insurer, pays for the harm. The legal minimum is only $25,000 per person and $50,000 per crash for injuries, plus $25,000 for property damage.
When the other driver has no insurance or not enough, your own uninsured/underinsured motorist (UM) coverage can help. Since 2009, Georgia UM coverage has been “added-on” by default. That means it pays in addition to the other driver’s limits, unless the policyholder chose “reduced-by” coverage in writing.
The 2025 tort-reform law
Georgia’s SB 68 was signed on April 21, 2025. Since then, juries in pending and new cases may hear evidence that an injured person wasn’t wearing a seat belt.
For claims arising on or after that date, juries may also hear what a health insurer actually paid. The defense can also look into treatment paid through a letter of protection.
